Divorce can encompass many different aspects including:
Child custody: Who will have custody of the children and what type of custody? Full physical custody to one parent, joint physical custody between both parents, full or joint legal custody.
Child support: Who will pay child support and how much? The amount is based on the Michigan Child Support Formula but it can be deviated if you can show special circumstances. The child support laws have significantly changed beginning in October 2008. If you have a current case, the new laws may have a direct impact on the amount of support you pay or receive. However, you must show a "change of circumstances" in order to modify an existing order to fall under the new laws.
Spousal support: Does one spouse need support? If you can show the "need" for spousal support, the court will grant it in certain situations. "Need" may be based on the inability for one spouse to earn income, reasonable living expenses exceeding income, etc. The length of the marriage, age, ability to be employed, and income of the other spouse are some of the factors reviewed by the court.
Property Settlement: Who receives what property? A division of property may include the marital home, household goods, retirement assets (401(k), IRA, 403(b), pension, etc.), vehicles, life insurance, investments, bank accounts, debts, etc.
